What you need to know about the SAVE Act
Updated 12 Feb 2026
"Our democracy works best when everybody can participate. But a new bill in Congress, the SAVE America Act — similar to its predecessor the Safeguard American Voter Eligibility (SAVE) Act — could silence millions of voters by creating new barriers to voter registration that make it harder for Americans to make their voices heard." -- Nicole Hansen & Emily Burns, The Campaign Legal Center
Background
Some of the many ways the SAVE America Act and the SAVE Act could prevent Americans from participating in the democratic process. Nicole Hansen & Emily Burns, The Campaign Legal Center 2.6.2026
Here are the top five things to know about the SAVE Act 2.0 and how you can help stop it. League of Conservation Voters 2.6.2026
The SAVE Act would disenfranchise Americans of all ages and races, but younger voters and voters of color would suffer disproportionately. Likewise, millions of women whose married names aren’t on their birth certificates or passports would face extra steps just to make their voices heard. Eliza Sweren-Becker & Owen Bacskav, the Brennan Center for Justice, 2.2.2026
Ultimately, the SAVE Act uses process and procedure as a proxy to disenfranchise many voters who otherwise meet the voter qualification standards of the state and federal constitutions. Franita Tolson, The Democracy Project 2.4.2026
Take Action
Update! The SAVE America Act passed in the House 218-213, with Democrat Rep. Henry Cuellar of Texas joining a unanimous republican vote. The bill now goes to the Senate, where Senate Minority Leader Charles E. Schumer say the legislation will be “dead on arrival." Still, voting rights groups such as the League of Women Voters and Color of Change stress the importance of calling senators.
During the week of February 9th, the House is set to vote on a new version of the SAVE Act, titled the “SAVE America Act.” This bill maintains the language of the original SAVE Act and adds new requirements that voters present a proof of citizenship both when registering to vote and when casting a ballot, drastically increasing the difficulty for eligible voters.
